1. DEFINITIONS

1.2. Personal data - any information about an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified directly or indirectly, in particular on the basis of an identifier such as a name, identification number, location data, internet identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of the natural person, including device IP, location data, internet identifier and information collected through cookies and other similar technology.

1.3. Processing - an operation or set of operations performed on personal data or sets of personal data in an automated or non-automated manner, such as collecting, recording, organizing, structuring, storing, adapting or modifying, retrieving, consulting, using, disclosing by transmission, disseminating or otherwise making available, matching or combining, limiting, deleting or destroying.

1.4. Policy – this Privacy Policy.

1.5. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

1.6. Website – website run by the Administrator at www.amth.pl

1.7. User – any natural person visiting the Website or using one or more services or functionalities described in the Policy.

2. GENERAL PROVISIONS

2.1. The website www.amth.pl, run by Wojciech Górzny, who runs a business under the name of "HYDROPRESS" Wojciech Górzny, is committed to respecting the privacy of people visiting his website. This Privacy Policy is a document that specifies the principles of processing data collected by www.amth.pl and their collection, access and method of storing information used on the Buyer's devices, also used via Cookies, during the implementation of services provided electronically.

2.2. The principles set out below are consistent with the legal standards in force in Poland and the European Union, with particular emphasis on the GDPR.

2.3. This privacy policy of the Service is for informational purposes only, which means that it is not a source of obligations for visitors to the Service.

2.4. Failure to accept this Privacy Policy by the User is tantamount to the inability to use the Website's services, including submitting Inquiries or Orders.

2.5. Personal data of the Visitor and the User are processed in accordance with the GDPR and the Act of 18 July 2002 on the provision of services by electronic means.

2.6. The Administrator takes special care to protect the interests of data subjects, and in particular ensures that the data collected by him/her are processed in accordance with the law; collected for specified, lawful purposes and not subject to further processing incompatible with these purposes; substantively correct and adequate in relation to the purposes for which they are processed and stored in a form which allows identification of data subjects for no longer than is necessary to achieve the purpose of processing.

3. PURPOSE AND SCOPE OF DATA COLLECTION AND DATA RECIPIENTS

3.1. Each time, the purpose, scope and recipients of data processed by the Administrator result from the actions undertaken by the Visitor or User of the Website.

3.2. Possible purposes of collecting personal data of Visitors or Users by the Administrator:

3.2.1. provision of services and ensuring appropriate User service,

3.2.2. conclusion and performance of an agreement for the provision of an Electronic Service (e.g. Account),

3.2.3. direct marketing of the Administrator's own products or services.

3.2.4. receiving and considering Users' objections and inquiries,

3.3. Possible recipients of personal data of Users and Visitors of the Website:

3.3.1. In the case of a Customer who submits an inquiry regarding the Administrator's offer, the Administrator shall make the collected personal data of the User available to a selected representative representing the Administrator within the network of Hydropress Branches and Sales Offices.

3.4. The Administrator may process the following personal data of Users or Visitors to the Website: name and surname; e-mail address; contact telephone number; delivery address (street, house number, apartment number, postal code, city, country), address of residence/business/registered office (if different from the delivery address). In the case of Users or Visitors who are not consumers, the Administrator may additionally process the company name and tax identification number (NIP) of the User or Visitor.

3.5. If the User grants consent to the processing of his/her personal data for marketing purposes (by accepting the appropriate Clause), the User's data will then be collected and used by the Service Provider or entities belonging to the "Hydropress" group in Poland - in the case of consent to sharing data, for the purposes of presenting a commercial offer and other marketing activities.

3.6. If the User grants consent to the processing of his/her personal data in order to receive commercial information in the form of sending a newsletter in accordance with art. 172 sec. 1 of the Act of 16 July 2004 - Telecommunications Law, then the User's data will be collected and used by the Service Provider or will be made available to entities belonging to the "Hydropress" group in Poland - only in the case of expressing the appropriate consent for this purpose. The User's consent to the processing of his/her personal data for the purposes of receiving commercial information means the User's consent to the processing of his/her personal data for marketing purposes.

3.7. Data collected through direct contact between the User and an employee/consultant of the Service Provider or Administrator are used solely for the purpose of contacting the User and providing assistance to the User.

4. COOKIES AND OPERATIONAL DATA

4.1. The Administrator uses cookies.

4.2. Cookies (so-called cookies) are computer data, in particular text files, which are stored in the User's end device and are intended for using the Service. Cookies usually contain the name of the website from which they originate, the time of their storage on the end device and a unique number. Cookies are used to create statistics, allow for automatic recognition of the computer's IP address on the next visit and allow for maintaining the logged-in User's session.

4.3. Cookies referred to in point 4.2. are files sent to the User's computer or other device while browsing the Service's website.

4.4. Cookies do not cause any configuration changes in the device or software installed on the User's device.

4.5. The User may not consent to the use of cookies (blocking cookies), which will prevent the storage of cookies on the User's device in the future.

4.6. A User who does not consent to the use of cookies (applies a cookie blocker) should select the appropriate settings in the web browser they are using. The process of consenting to the use of cookies varies depending on the browser used by the User.

4.7. A User who wants to delete existing cookies should select the appropriate settings in the web browser they are using or delete cookies manually. The process of deleting cookies varies depending on the browser they are using.

4.8. The Service Provider warns that blocking or deleting cookies may cause difficulties in using the Service and, in some cases, prevent the use of some of its options.

4.9. The Administrator may process data contained in Cookies when visitors use the Service for the following purposes:

4.9.1. identifying Service Users as logged in to the Service and showing that they are logged in,

4.9.2. remembering Products added to those viewed by the User while visiting the Website.

4.9.3. remembering data from completed Contact Forms, product inquiries, and surveys.

4.9.4. customizing the content of the Service page to the individual preferences of the Service User (e.g. regarding colors, font size, page layout) and optimizing the use of the Service pages,

4.9.5. keeping anonymous statistics showing how the Service is used.

4.10. The settings of the web browser regarding Cookies are important from the point of view of consent to the use of Cookies by our Service - in accordance with the regulations, such consent may also be expressed through the settings of the web browser. In the absence of such consent, the settings of the web browser regarding Cookies should be changed accordingly.

4.12. The Administrator also processes anonymized operational data related to the use of the Service (IP address, domain) to generate statistics helpful in administering the Service. This data is aggregated and anonymous, i.e. it does not contain features identifying persons visiting the Service page. This data is not disclosed to third parties.

5. BASIS FOR DATA PROCESSING

5.1. The provision of personal data by the Service Recipient or User is voluntary, however, failure to provide the personal data indicated on the Website necessary to conclude and perform the agreement for the provision of Electronic Services results in the impossibility of concluding said agreement.

5.2. The basis for processing the personal data of the Service Recipient or User is the necessity to perform the contract to which they are a party or to take action at their request before its conclusion. In the case of processing data for the purpose of direct marketing of the Administrator's own products or services, the basis for such processing is (1) the prior consent of the Service Recipient or User or (2) the fulfillment of legally justified purposes realized by the Administrator in accordance with the GDPR.

6. THE RIGHT TO CONTROL, ACCESS AND CORRECT YOUR DATA

6.1. The Service Recipient, Visitor or User has the right to access the content of their personal data and to correct them.

6.2. Every person has the right to access their personal data, to supplement, update, rectify, request the cessation of processing, to delete personal data if they are incomplete, outdated, untrue or have been collected in violation of applicable law or are no longer necessary to achieve the purpose for which they were collected.

6.3. If the Service Recipient, Visitor or User grants consent to the processing of data for the purpose of direct marketing of the Administrator's own products or services, the consent may be withdrawn at any time.

6.4. If the Administrator intends to process or processes the data of a Service Recipient, Visitor or User for the purpose of direct marketing of the Administrator's own products or services, the data subject is also entitled to (1) submit a written, reasoned request to cease processing of his or her data due to his or her special situation or to (2) object to the processing of his or her data.

6.5. In order to exercise the rights referred to above, you can contact the Administrator by sending an appropriate message in writing or by e-mail to the Administrator's address indicated at the beginning of this privacy policy.

7. PERSONAL DATA PROTECTION

7.1. The Service Provider and third parties as personal data controllers apply technical and organizational measures necessary to protect data required by the GDPR (appropriate to the threats and categories of data subject to protection), in particular they protect the personal data of Users against making them available to unauthorized persons, loss or damage.

7.2. The User is obliged to adequately protect the password against disclosure to third parties.

7.3. The User bears sole responsibility and risk related to disclosing the password to third parties (also as a result of inadequate protection of the password against access by third parties) or enabling them to use their Account in any other way.

7.4. The User is obliged to immediately notify the Service Provider of any use of his Account by unauthorized persons or of any other breaches of security rules related to the use of the Service identified by the User.

7.5. The Administrator shall provide the following technical measures to prevent unauthorized persons from obtaining and modifying personal data sent electronically:

7.5.1. Securing the data set against unauthorized access.

7.5.2. Access to the Account only after providing an individual login and password.

7.6. The Administrator conducts ongoing risk analysis to ensure that personal data is processed by him in a secure manner – ensuring, above all, that only authorized persons have access to the data and only to the extent necessary for the tasks they perform. The Administrator ensures that all operations on personal data are recorded and performed only by authorized employees and collaborators.

7.7. The Administrator shall take all necessary measures to ensure that its subcontractors and other cooperating entities guarantee the application of appropriate security measures whenever they process personal data on behalf of the Administrator.

8. FINAL PROVISIONS

8.1. The Service may contain links to other websites. The Administrator encourages you to read the privacy policies established there after going to other websites. This privacy policy applies only to the Service in question.

8.2. Any additional questions regarding the Privacy Policy should be directed to the Service Provider's address indicated in the introduction to this Policy.

8.3. The Service Provider is entitled to unilaterally change the Privacy Policy in the event of: (a) circumstances of force majeure, (b) changes in applicable legal provisions applicable to the provision of services by electronic means or transactions concluded remotely, (c) changes in the Administrator's offer posted on the Service website, provided that the changes to the Privacy Policy are intended to adapt the content of the Privacy Policy to the offer and its terms. The Service Provider will notify the User of each change to the Privacy Policy, in the form of a message sent to the e-mail address provided to the Service Provider by the User (indicated in the registration data entered by the User). Users and Visitors will be bound by the provisions of the new Privacy Policy, unless they terminate the Privacy Policy within thirty (30) days from the date of their notification of the change to the Privacy Policy. The change to the Privacy Policy, to the extent that its provisions apply to agreements for the provision of services within Products other than Goods, does not change the content of agreements concluded before the change to the Privacy Policy.
